Comme je vous l'avait présenté dans un post il y a quelques temps, c'est en train de bouger pour les étrangers. Pour ceux ne lisant pas le chinois, voici quelques éléments important à ne pas louper :

Permis de résidence pour ceux travaillant en Chine :

• Au bout du troisième visa de travail, le travailleur étranger pourra demander un permit de résidence pour travailler d'une durée de 5 ans.

Pour les étudiants :

• Il s'agit la d'une grande déception pour les étudiants étrangers espérant travailler directement à Shanghai en utilisant leur diplôme chinois. La nouvelle régulation est particulièrement difficile à suivre, touchant principalement les étudiants ayant eu un diplômes d'une université ou d'une institution de l'enseignement supérieur (donc pas d'école de langue) ET qui dispose d'un business plan ou souhaitant ouvrir leur entreprise ET qui ont un resident permit pourront demander une altération de leur résident permit leur permettant de faire du "business" pendant deux ans. Donc exit le working visa pour les étudiants "classiques".

Visa talents étrangers :

• Nombreuses modifications du statut de talents étrangers notamment avec notamment la suppression des catégories professionnelles. Techniquement un somelier peut être un talent étranger.
• Possibilité de demander une "green card" après 4 ans de travail en Chine, dont présence minimum de 6 mois consécutifs par an.

Plus général :

• Réduction du temps d'approbation de la "green card" pour les travailleurs étrangers et talents étrangers de 180 jours à 90jours
• Le porteur d'un visa de travail peut demander la création d'un nouveau visa de travail directement à Shanghai (assez vague).
• Mise en place d'une catégorie "entrepreneuriale" favorisant la création d'entreprise à Shanghai par les étrangers.
• D'autres dispositions, une fiscale concernant les impôts, une autre touchant le personnel de maison. (N'hésitez pas à me demander en cas de doute)

15 octobre 2014 --> 30 novembre 2014 - deuxieme permis (démission)
1 decembre 2014 --> maintenant - 3eme permis (valable jusqu'au 30 novembre 2015)

Ils changent les règles pour dire qu'ils les assouplissent mais ils adaptent clairement les modalités à la situation actuelle et au final, à part dans quelques secteurs et pour certaines sociétés, cela ne changera pas grand chose au final ...

De toute manière, tant qu'il ne change pas les modalités et règles "normales" dans l'obtention du permis de travail et du permis de résidence qui va avec, cela me convient de le faire tous les ans, comme depuis ces 15 dernières années ....

C'est exactement ce que j'ai dit a ma femme hier.

Aucun interet d'avoir un Residence permit de 5 ans s'il est annule quand on change de boite et qu'il faille tout recommencer.
Ma boite fait toute la procédure pour moi et mon gamin (via une agence de staffing) et nouveauté cette année je n'ai même pas eu besoin de montrer ma tête au PSB pour le renouvellement du residence permit.

Comme toujours des effets d`annonces . Bref rien de nouveau , sauf qu`il faut bien montrer que l`administration chinoise est a l`écoute des réclamations et qu`elle évolue .
Ce genre d`annonce intervient au même instant que l`entente sur l'octroi réciproque de visas de 5 ans pour leurs hommes d'affaires, signée il y a deux jours entre Paris et Beijing .
Mais quels seront les termes qui définiront un homme d`affaires? Mystère et boule de gomme.
